Please read these Terms and Conditions carefully as they contain important information about your booking with Rawson Touring. By making a booking, you agree to be bound by these Terms and Conditions.
1. Definitions
"Company" or "We" or "Us" refers to Rawson Touring, a tour operator based in Gqeberha, Eastern Cape, South Africa.
"Client" or "You" refers to any person making a booking or intending to make a booking with the Company.
"Tour" refers to any guided travel package or activity offered by the Company.
"Booking" refers to the confirmed arrangement of a Tour by the Client.
"Price" refers to the total cost of the Tour as quoted by the Company.
"Force Majeure" refers to any event beyond the Company's reasonable control, including but not limited to acts of God, war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, epidemics, pandemics, government actions, and any other external circumstances.
2. Bookings and Reservations
2.1. All Tours are subject to availability.
2.2. A Booking is considered confirmed only when the Company issues a written confirmation (e.g., email) after receiving the required deposit or full payment.
2.3. The person making the Booking warrants that they have the authority to accept and do accept these Terms and Conditions on behalf of all persons included in the Booking.
2.4. It is the Client's responsibility to ensure that all details provided during the booking process are correct and complete. The Company will not be responsible for any errors or omissions.
2.5. Special requests (e.g., dietary requirements, accessibility needs) must be communicated to the Company at the time of booking. While the Company will endeavor to accommodate such requests, they cannot be guaranteed.
3.a) Payment Policy Multi¬day tours
3.1. A non-refundable deposit of 25% of the total Price is required to secure a Booking, unless otherwise specified.
3.2. The remaining balance of the Price must be paid no later than 15 days prior to the Tour departure date, unless otherwise specified.
3.3. Payments can be made via accepted methods as communicated by the Company (e.g., electronic funds transfer, credit card or cash on our day tours).
3.4. If the full balance is not received by the due date, the Company reserves the right to cancel the Booking and retain the deposit.
3.5. Prices quoted are in South African Rand (ZAR) and include Value Added Tax (VAT) where applicable.
3.6. The Company reserves the right to amend prices at any time before a Booking is confirmed. Clients will be notified of any price changes before confirmation.
3.b) Payment policy Day ¬ tours
3.1 No deposit required For day tour, you may be able to choose the "Reserve now, pay later" feature. 72 hours before the start of the Activity we will request the full payment if you choose online payment method. If this fails and the payment is not made, we will automatically cancel the Activity you booked unless communicated otherwise.
4. Cancellation by the Client
4.1. All cancellations must be communicated to the Company in writing (e.g., email).
4.2. Cancellation charges will apply as follows:
* More than 15 days prior to departure: Loss of deposit.
* 12-8 days prior to departure: 50% of the total Price.
* 7-5 days prior to departure: 75% of the total Price.
* Less than 5 days prior to departure or no-show: 100% of the total Price.
4.3. For tailor-made Tours, specific cancellation terms may apply and will be communicated at the time of booking.
4.4. No refunds will be given for any unused portion of a Tour once it has commenced.
4.5 All of our full/half day tours are subjected to 35 hours free cancellation policy for a full refund
5. Cancellation and Changes by the Company
5.1. The Company reserves the right to cancel a Tour at any time due to Force Majeure or any other circumstances beyond its reasonable control. In such cases, the Client will be offered either a full refund of all monies paid or an alternative Tour of comparable value (subject to availability). The Client shall not be entitled to any further compensation.
5.2. The Company reserves the right to make changes to the Tour itinerary, accommodation, transportation, or other arrangements at any time, provided that such changes do not significantly alter the overall nature of the Tour. Clients will be informed of any significant changes as soon as reasonably possible.
5.3. If a significant change is made that the Client is unwilling to accept, the Client may be offered a full refund of monies paid or an alternative Tour of comparable value (subject to availability).
6. Client Responsibilities
6.1. Clients are responsible for ensuring that they possess the necessary travel documents, including passports, visas, and health certificates, valid for the duration of the Tour. The Company can provide general information but it is the Client's responsibility to verify specific requirements.
6.2. Clients are responsible for their own health and safety and should be aware of any potential risks associated with the Tour. It is recommended that Clients consult their doctor regarding any necessary vaccinations or health precautions.
6.3. Clients are expected to behave in a responsible and respectful manner towards other participants, Company staff, and members of the public. The Company reserves the right to exclude a Client from a Tour if their behaviour is deemed offensive, disruptive, or dangerous, without any right to a refund.
6.4. Clients are responsible for their personal belongings. The Company will not be liable for any loss or damage to personal items.
6.5. It is the Client's responsibility to have adequate travel insurance to cover medical expenses, personal injury, loss of belongings, cancellation, and curtailment of the Tour. The Company may request proof of insurance prior to departure.
7. Liability
7.1. To the fullest extent permitted by law, the Company shall not be liable for any loss, damage, injury, illness, death, delay, or expense whatsoever arising directly or indirectly from any aspect of the Tour, including but not limited to:
* Acts or omissions of the Client or any third party.
* Force Majeure events.
* Accidents, illnesses, or other unforeseen circumstances.
* Changes to the Tour itinerary or arrangements.
7.2. The Company's liability for any claim arising out of a Booking shall be limited to the total Price paid by the Client.
7.3. Clients participate in Tours at their own risk. Certain activities may carry inherent risks, and Clients are responsible for assessing their suitability and taking necessary precautions.
8. Complaints
8.1. Any complaints regarding the Tour must be brought to the attention of the Company's representative during the Tour so that the issue can be addressed promptly.
8.2. If a complaint cannot be resolved on the spot, it should be submitted in writing to the Company within 30 days of the Tour end date, providing full details of the issue. The Company will investigate the matter and respond within a reasonable timeframe.
9. Governing Law and Jurisdiction
9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
9.2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
10. Data Protection
10.1. The Company will collect, use, and disclose the Client's personal information in accordance with its Privacy Policy, which is available upon request or on the Company's website (if applicable).
11. Amendments
11.1. The Company reserves the right to amend these Terms and Conditions at any time without prior notice. The latest version will be available on the Company's website (if applicable) or upon request.
By proceeding with a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
